About LinkDog LinkDog is a local business discovery and ordering platform that helps users find restaurants, shops, hotels, and other local businesses. The Platform may provide services including: Business listings Online ordering Delivery coordination Promotions and advertisements Membership programs Customer reviews and ratings Customer support services LinkDog acts solely as a technology platform connecting users, merchants, and delivery providers. LinkDog does not manufacture products, prepare food, or directly provide delivery services unless explicitly stated. 2. Eligibility You must be at least 18 years old, or the legal age required in your jurisdiction, to use the Platform. By using LinkDog, you represent that: You are legally able to enter binding agreements The information you provide is accurate and current You will comply with all applicable laws and regulations 3. Delivery Services Delivery services available through the Platform may be performed by: Independent delivery providers Third-party services Merchants directly Estimated delivery times are provided for convenience only and are not guaranteed. LinkDog is not liable for delays caused by: Traffic Weather Merchant delays Incorrect delivery information Events outside our reasonable control Risk of loss transfers to the customer upon successful delivery. 6. Merchant Responsibilities Merchants using LinkDog agree to: Maintain accurate business information Comply with all health and safety laws Maintain required licenses and permits Fulfill accepted orders responsibly Maintain accurate pricing and availability Merchants are solely responsible for: Their products and services Food quality and safety Taxes and legal compliance Customer disputes related to their business 7. Independent Contractors Delivery providers and other service providers using the Platform are independent contractors and are not employees of LinkDog. Nothing in these Terms creates: Employment relationships Partnerships Joint ventures Agency relationships Independent contractors are solely responsible for: Taxes Insurance Vehicle expenses Compliance with local laws 8. Membership Programs LinkDog may offer optional membership or subscription services. Membership terms may include: Monthly or annual recurring fees Promotional delivery benefits Exclusive offers or discounts Memberships automatically renew unless canceled before the renewal date. Intellectual Property All content and materials on the Platform, including: Logos Branding Software Designs Text Graphics are owned by LinkDog or its licensors and protected by applicable intellectual property laws. You may not copy, reproduce, modify, distribute, or commercially exploit Platform content without written permission. 11. Prohibited Activities You agree not to: Use the Platform unlawfully Interfere with Platform operations Attempt unauthorized access Upload malicious code Use automated scraping tools without permission Impersonate others Manipulate ratings or reviews 12. Third-Party Services The Platform may integrate third-party services including: Payment processors Maps and navigation services Analytics providers Merchant systems LinkDog is not responsible for third-party services, products, or websites. 13. Disclaimer of Warranties The Platform is provided on an “AS IS” and “AS AVAILABLE” basis. LinkDog makes no warranties regarding: Platform availability Accuracy of listings Delivery timing Merchant quality Error-free operation To the fullest extent permitted by law, LinkDog disclaims all warranties, express or implied. 14. Limitation of Liability To the maximum extent permitted by law, LinkDog shall not be liable for: Indirect damages Lost profits Lost data Delivery issues Merchant disputes Personal injury Food-related illness LinkDog’s total liability shall not exceed the amount paid by the user to LinkDog during the previous three (3) months. 15. Indemnification You agree to indemnify and hold harmless LinkDog and its affiliates from claims, liabilities, damages, and expenses arising from: Your use of the Platform Your violation of these Terms Your content or activities Your interactions with merchants or service providers 16. Termination LinkDog may suspend or terminate access to the Platform at any time for: Violations of these Terms Fraudulent activity Harmful conduct Legal or regulatory reasons Users may stop using the Platform at any time. 17. Privacy Your use of the Platform is also governed by the LinkDog Privacy Policy. 18. Changes to These Terms LinkDog may update these Terms from time to time. Governing Law These Terms shall be governed by the laws of the State of California, United States, without regard to conflict of law principles.
